General
Terms
and Conditions of Sale are important because they create certainty
between both parties. They detail the responsibilities of both
ourselves, LimeStoneFires.Com ("The Seller") and you, ("The
Buyer").
Our terms and conditions comply with existing legislation including
the Sale of Goods Act 1979 (as amended); the Consumer Credit
Act 1974, if appropriate, (as amended) and any legislation relating
to restrictive trade practices.
For
all business transactions between the Buyer and the Seller,
the terms and conditions of LimeStoneFires apply.
All
orders for purchase are on condition that these terms are accepted
by the purchaser at the time an order is being placed. LimeStoneFires
accepts no liability for any product or service advertised,
supplied or otherwise promoted on this site by any third party.
LimeStoneFires does not warrant that any of the goods or services
linked to or advertised on this site comply with data protection
or other relevant legislation and LimeStoneFires accepts no
liability whatsoever for any claim arising from such goods or
services.
Your
statutory rights are not affected.
Delivery
& Pricing
Please
note that delivery charges may normally range from £9.50
for small packages up to £25.00 for larger consignments,
charged by weight by our carriers.
Deliveries
to customers are via our own van delivery, direct from the manufacturer,
or by proprietery parcel or freight carriers. Arrangements to
have goods delivered to the Buyer by other means and/or at a
future date should be made at the time of purchase if possible
- the Buyer can arrange a date by which he/she wants them to
arrive.
If
we are unable to deliver by this agreed date the Buyer may cancel
the order and all monies paid to LimeStoneFires will be returned
to him/her in full. However, if a delivery date has not been
agreed, goods should still arrive within a "reasonable time"
- usually within 14 days.
This
so-called "reasonable time" may be varied where a Third Party
is used to deliver the goods (eg. UPS, TNT, Securicor, etc),
in which case delivery date is outside the control of the Seller
(LimeStoneFires.Com), and they cannot be held directly responsible
for Third Party failures to deliver on time.
If
the Buyer agrees to wait for a certain time for delivery, and
subsequently changes his/her mind, and cancels the order within
this waiting time, it will be deemed to constitute a Breach
of Contract and he/she will forfeit all monies and/or deposits
paid to LimeStoneFires by way of contract.
Buyers
should inspect goods on delivery to ensure that they are correct,
in order and free from damage or other defects.
Please
note that delivery charges cannot be automatically included
in charges for online purchases, as charges vary according to
the weigth of the consignment. These charges will be added later.
All
prices listed on this website are GROSS, including any appropriate
taxes and in UK Pounds Sterling (£ or GBP), but excluding delivery
charges which are added to the overall cost of items. Please
note that our prices quoted do NOT include Delivery Charges.
Any shipping costs are in addition to the quoted prices and
need to be added to product prices.
Payment
in other currencies (eg. In Euro) can be quoted for. All prices
are subject to change without notice, but are fixed at the time
of Order/Purchase to the advertised price at that time.
Delivery
charges normally range from £9.50 for small packages up
to £25.00 for larger consignments. Unfortunately, it is
not possible, for technical reasons, to add delivery charges
through our automated online purchasing facility - delivery
charges will be added later by us.
Warranties
& Guarantee of Quality of Goods Supplied
The
Seller guarantees the product for 12 months from the day of
purchase. We operate a full satisfaction policy and if you are
not happy with the goods supplied when they are delivered we
will take goods back immediately and refund any monies already
paid to us. You should therefore satisfy yourself at the
point of delivery that goods are satisfactory, and if not,
you should refuse to accept them from the deliverer or carrier,
who will return them immediately to us. Normal Manufacturer's
guarantees also apply. Your statutory rights are not affected.
Before they buy goods Buyers should satisfy themselves that:

Goods are of in perfect condition and should have no "unacceptable"
defects, apart from those pointed out to you by the seller
at the time of purchase;
- Goods
are fit for the purpose for which you intend to use them
- including any particular purpose you mention to the seller.
For example, whether you intend to use a fireplace as a
functional fitting, or purely for decorative non-functional
purposes, you should ensure that the product you intend
to purchase is fit for that purpose. Similarly, if you intend
to burn a particular fuel (coal or a gas fire for example)
you should ensure before buying that the product you intend
to buy is capable of burning that fuel. We are happy to
advise and discuss compatibilities with you;

Goods are as described - by the seller and/or in the catalogue
descriptions on this website.
Please
note that any faults due to negligence, rough handling or unfair
treatment after receipt and acceptance of goods are not covered
by guarantee. Basically, if the fault is clearly ours then LimeStoneFires
will honour all guarantees on our products. However, if the
fault is the Buyer's we cannot be held responsible. Buyers should
therefore inspect goods on delivery, and should refuse to accept
delivery where there is damage or other faults in evidence as
a result of transportation. After the Buyer has accepted delivery,
we cannot be held responsible for subsequent damage. We may
however be prepared to make some reparations, but this is at
our sole discretion and on the basis of goodwill, and not on
the basis of any liability on our part.
Orders
of Purchase
Fireplaces,
fittings and accessories are available through direct orders
made to us online. Filling in and sending the online Order Form
does not in itself constitute a contract, and we reserve the
right not to trade or deal, for any reason we deem fit, and
at our sole discretion. However, once confirmation of an Order
has been received by the Buyer from LimeStoneFires for the purchase
of goods, whether made in writing, verbally by telephone, by
electronic means online, or by word of mouth, this will constitute
a Legal Contract to purchase and supply between the Buyer and
the Seller, and as such is subject to the Laws of Contract in
the United Kingdom.
Dimensions
and Specifications
While
we have made every effort to ensure the accuracy of the information
supplied on this website relating to dimensions and specifications,
errors do sometimes occur. Therefore, stated dimensions should
only be taken as a general guide, and the onus is upon the Buyer
to check and ensure for himself/herself the accuracy of all
information relating to the product in question. Due to the
possibility of errors, any typographical, clerical or other
error or omission in any information given by us (including
in relation to the price of the products) shall be subject to
correction by us without your authority and we will not be responsible
for any consequences arising from such inaccuracies.
Please
note that all colours and finishes illustrated in our catalogue
are approximations at best and that actual colours and finishes
may vary from those shown. We reserve the right to change specifications
where necessary.
Order
Acceptance
The
receipt by us of an Order from a prospective Buyer does not
constitute the acceptance of an Order or confirmation of an
offer to sell on our part. We reserve the right to refuse to
sell at our own discretion and also reserve the right to limit
the quantity of an Order for any item. Subject to the other
Terms and Conditions contained on this web page, any Order shall
only be deemed to have been accepted by LimeStoneFires when
we have expressly confirmed that we have accepted your Order.
Payments
Payment
may be made with order online with Visa and Mastercard. Cheques
must be paid in advance and must be cleared before delivery.
Established customers may be invoiced by prior arrangement.
Invoices must be paid in full within 30 days of Invoice date.
Failure
to pay by the due date may incur interest penalties, which will
be added to the account at the rate of 10% per month of the
outstanding balance. Cash on Delivery arrangements can be made
by prior agreement.
Refunds
Refunds
will be given where fair and appropriate. The Buyer may not
be entitled to any refund in the following circumstances:
- If
they were told about the fault at the time of purchase;
- If
they examined the goods before they bought them, were satisfied
with their quality at the time, and should have seen the
fault for themselves;
- If
they did the damage themselves;
- If
they change their mind.
However,
as a sign of goodwill Cast Iron Fires may offer a refund, a
credit note or an exchange at their discretion. Please note
that if a customer simply changes their mind regarding the purchase,
and where goods are supplied exactly as ordered by the client,
and where those goods are returned to us in perfect condition,
we reserve the right to deduct a 10% re-stocking charge from
the refund of the original purchase price.
Responsibility
& Ownership
All
articles remain the property of LimeStoneFires until payments
are received in full.
None
of the above Terms & Conditions affect your statutory rights
under English law.
